The Law [Due by Friday 11/20]

How does the criminal and civil law help insure justice for all citizens in the United States of America? [To prove your points use specific examples from what you have learned in class about the law]

Is the criminal justice system fair? [Why/Why not]

31 comments:

  1. Civil law helps and protects people by letting people be able to sue for what they deserve from someone. Such as if you where cheatting someone out of what they bought for you, like that Judge Judy case about the e-bay phones. It also helps the other side, by them be able to see all the evidence before court.

Criminal law is good for the pepole. Criminal law helps and protect people who are voilent and hurtful to others. Such as if you were to kill someone. These law can put you away with enough evidence. If you don't speack the truth about everything you can be put in kail up to a year like Lil Kim.

  2. Civil law is very important because it protects the peoples rights and insures that no one has the right to take those away from you. Like if you own property and someone destroy's it they should have to pay damages because yhat property is rightfully yours.Without civil law peoples rights would be useless.

Criminal law is just as important. Without criminal law the U.S. would be a harmfull and terrible place. This is important to save the lives and also the way Americans live today. Someone does not have the right to kill someone and get away with it. This person or persons should be put in jail and not have the right to live there life free when they take another life. So criminal law is very importsnt so the U.S. can be the best it possibly can be.

  3. Criminal law helps to ensure that criminals are tried and proven before being released. If there was no criminal law there would be more crime because the criminal law is like a filter for criminals. It sorts the criminals from the innocent people with a jury trial so that criminals are not let out on the streets without evidence of his or her innocence.

Civil law helps to protect and ensure that peoples' rights are protected and not violated. An example of a civil crime that would need the civil law would be destruction of private property. If someone went over to another persons house and took a baseball bat to that persons' car because he or she did not like something that that person had said. The person who ownes the car would have the right to take that him or her to court for the damages. Civil law would most likely encourage the court to rule in the car owners favor because the owner had the right to speak freely and the other person did not have the right to destroy the car.

The criminal justice system is fair because it gives an assumed criminal the right to a fair trial. If a person is arrested for a crime on assumptions, the criminal justice system would prove or disprove those assumptions. If a person is guilty then the criminal justice system proves that and gives him or her the proper punishment for the severity of his or her crime.

  4. Criminal law is good. Because it helps in making sure if someone is guilty or innocent. If we didn't have this then people would be released without knowing if they were innocent or not. If you think the world is scary now, if we did not have criminal law it would be 3times as bad. It would be terrible. This is very important, so more lives are saved.

I believe Civil law helps make sure everything goes ok. As in that I mean if your money got stolen or your property was damaged wouldn't you like your property fixed, or to get your money back? This helps with that. It makes everything fair when something like that happens.

Criminal justice system is fair because it gives the person a right to a fair trial. Instead of doing them wrong they can auctally have the right to see if they are innocent or guilty. "You are innocent until proven guilty in the court of law" this is true. You will get your proper punishment for your crime. So yes, I would definitely have to say that the Criminal justice system is a very good thing.

  5. Criminal law deals with violations of a law. Criminal law helps to protect citizens by removing dangerous people such a rapist and murderers off America's public streets. With enough evidence in court those types of people are placed in jail, and kept there for an amount of time depending on the crime committed. That serves justice because the criminal deserved what they got and it also protects everyday people.

Civil law allows people to remedy against others who have wronged them. For example, someone may have been lied to about a product on the internet. Then after they purchased the item it was nothing like what was described in the ad they received. In most of these cases no one goes to jail. Although the liable person gets fined or otherwise punished for what they had done.

Yes, I do believe America's criminal justice system is fair. Punishment for crimes and wrongdoings are processed thoroughly, and based on the severity of their acts. In most cases justice is served, and that is the way this system should work.

  6. Criminal law ensures the safty of people by enforcing laws onto the public. Some violations of criminal law are rape, murder, and extream cases of theft. When a judge/and or jury convict people of these crimes, its puts the criminals in jail, keeping everyone else safe.

Civil law allows people who have had their rights/freedoms violated, to have justice. Some cases of civil law are petty theft, ilegal dumping, and dog bites. An example of this was in the Judge Judy case. The plaintiffs who paid for the cell phones should have received those phones. Instead, the defendant sent them pictures. Since the plaintiffs had a wrong doing brought apon them, they receive justice by having their case heard in a court of law, and receiving their money back.

I do believe that America's criminal justice system is fair. People are brought to court, tried, and conviced. In most cases, people receive rights, freedoms, and a sense of security. I think that the criminal justice system works because it shows the fairness of the law by allow ordinary people to have justice.

  7. Civil law is important for someone if they want remedy over someone who done them wrong. This protects people for the property. Like if somemone crashes another person car and breaks a window. This also helps against someone taking another's money and then screwing them over. Like that video we watch today of Judge Judy. That brown haired lady paid for two phones and got two pictures of phones. That was wrong and in the end the lady that didn't get the phones got 5,000 dollars in return.

The criminal law helps with violations of the law of the country. This helps keep the bad awway from the good people. Say if someone kills someone, then that a felony and that killer goes to jail. The with misdomeanors that just for people who steal, but if they keep on getting misdomeanors they will go to jail. This will help people to relaize they should make better decisions.

Yes, it is fair. It is a sstem that will help people that are not guilty be proven not guilty and the people guilty be proven guilty.

  8. 1. Criminal law is for the more heinous crimes. Criminal law deals with murders, robbery, and rape, etc. In most of the cases that criminal law partakes in, there is a trial. A trial can sometimes be avoided if there is a plea bargain put into action. In order for a defendant to be found guilty the prosecution must present evidence called burden of proof. In a case, both sides get an equal amount of time to tell their side of the story. In the end, justice is hopefully served to the person who deserves it.
    2. Civil law is about someone seeking damages or (money) from someone else. Just like the video we watched, both the accused and the plaintiff tell their story to the judge. The plaintiff must show the burden of proof against the defendant. If the judge rules in the favor of the plaintiff, then an award is given to the plaintiff from the accused.
    3. I believe that the criminal justice is fair. In America, everyone has the right to a trial and has the "chance" for their case to go in their favor. It’s fair that the criminal justice allows for both sides to tell their story and in the end justice is served.

  9. Criminal Law helps to ensure that justice is served and to make sure criminals are tried and not released if they threaten the lives of other citizens. Criminal Law protects the people from dangerous criminals, such as rapist and murderers. Without it we would have really dangerous criminals out on the streets. Civil law protects us from criminals that are not as dangerous but still do us harm, like for instance, in the judge Judy case, girl and her mom were scammed and they were given money to make up for what the lady did to them. Without the Civil Law the lady who tried to be smart and pretty much steal her money, would have gotten away with it.

I think that the Criminal justice system is fair because it gives the criminal a fair trial just in case they really aren't criminals. All of the evidence is examined carefully to determine the fate of those people, after they are tried they are either convicted or released. Justice is served for the most part and I believe that, that is a really good thing, because it keeps us safe from criminals.

  10. Criminal law ensures that justice is served. They are also useful beause they protect us from rapist and murderers. They put the bad behind bars and the good on the streets.
Civil law protects us from criminals that do us harm, for instance on the Judge Judy case the plantiff was suing because they got scammed out of cell phones, they payed money and the defendent gave them pictures of cell phones and for the harm that the defendent caused now they will have to pay it all back.Without this law the defendent would of gotten away.
Criminal Justice system is very fair because it gives the criminals a fair trial. Evidence has to be examined very careful to be determined guilty or not guilty.

  12. Criminal law helps insure justice by keeping murders, thieves, and rapist off america's streets. If they get enough evidence on that person that did the crime they are probably going to jail. The criminal law helps to protect people from the criminals out in this world.
The civil law helps insure too by letting people give their solution on what that person did wrong to them. For example, in the judge Judy case. There was this woman that bought two cell phones off ebay website. She recieved two pictures of a cell phone. Her and the person that sold the two pictures went in front of the judge so she could give her remedy for what that person did to her. She won the case and recieved money.
I believe the criminal justice system is fair because it gives everyone the right to have a fair trial. both sides can show their evidence and voice their opinions so either side could have a chance to let the case go there way.

  13. Civil laws insure citizans rights by letting them sue for loss of property, personal rights and seeks damages or money. This lets the American citizens be able to sue for things that have happened to them that they think they should recieve money for. One example would be the judge Judy case where the woman sacammed the buyers out of their cell phones by giving them pictures no the acutal cell phones. Another example would be a dog bite.
Criminal laws is for more serious crimes like murder or rape. This is when the prosecution can call witness to testify and you could have a court order to for a subpenoas. So that witness have to appear to testify.
I believe that the criminal justice system is fair. It provides criminal a trial. Also it lets both sides tell their side of the story.

  14. 1. Civil law protests us by making sure we have our rights, and that no one could take that awauy from us. For example, if little Bobby Junior throws a rock through the window of you house, you have the right to take the family to court for the window repair. This is a fair system, so the court would most likely rule in favor of the family whos window got knocked out. Civil law makes sure you are served the correct justice.

    2. Criminal law helps keep harmful people off the streets. This makes sure that criminals are tried and proven before being released. Without this, guiltly people would be let go and that would be harmful for everyone else who has to deal with that person. But with criminal law, people are put in jail if proven guilty. Criminals deserve what they get when criminal law proves they did the crime. This keeps everyone safe!

    3. I believe that the criminal justice system is very fair. The reason is because it gives everyone the right to a fair trial. This lets everyone, even the guilty, have some sort of justice. They have the chance for their case to go in favor of the way they believed it should go. So this is why I think it's a very good thing for the criminal justice system to be in affect.

  15. Civil Law is designed to make that all american citizens rights are not violated and if so, have the right to a trial in front of a judge. Say your house is egged and some windows are broken from it. If you know who did it then you could take them to court to pay for the broken windows.

Criminal Law deals with the more serious acts that usually ends up in jail time or life sentences. It keeps the most dangerous people off the streets and allows us to have strict order in our country. You also have the right to a trial for this act, but unlike civil acts, it often ends with more serious outcomes. If you happened to kill someone for some crazy reason and you was caught, then you would be tried and given a lifes sentence or numerous amounts of years depending on how bad the murder was.

Yes I believe our criminal justice is fair in the United States because it is strict enough to get the worst of the worst off the streets and put fear in people from even thinking about a crime. I do not believe in some states not allowing the death penalty because if you killed a human being, (other than self defense) then your life should be destroyed also. No matter if it's one person or ten, they should all recieve the death penalty. Other than that, our criminal justice system is perfect in my mind and wouldnt change it one bit.

  16. I think Civil Law helps protect people by if they get something or order something and didnt get what they had ordered they have the right to sue them for what its worth. Such as the judge judy case where a women bought to phones and got two pictures of the phones she was able to sue the woman who she was buying from for what the phones were worth and for scamming her.

Criminal Law is also very important because without this the world would be very dangerous and not safe for anybody. Like if somebody killed somebody and went to court and was guilty because of the evidence that there was.

  17. Criminal law is a system of justice that helps put away those who violate the criminal law.It helps keep the murderers, rapists, and thiefs off of the street and keep them away from hurting us. Those who violate a criminal law are arrested and processed by law enforcement and then set up for trial. Depending on how serious the crime depends on wether it is a felony which is more serious or a misdemeanor which is less serious. Felonies are the ones that get the more severe punishment like a life sentence to prison or the death penalty for things like rape and murder. These kinds of punishments and law enforcements are what help keep us safe and try to prevent these kinds of things from happening.
Civil cases are less serious. For the most part they are people who are suing for loss of property, personal rights, damages or money. Every american has the right to have their hearing before a judge in these cases and the judge decides the ruling.
I think the justice system is fair for the most part but sometimes people have to pay for the crime that they didnt commit. But for the most part i think its a pretty good thing because it keeps us safe.

  18. Criminal Law is what take the people that violate criminal law. It helps keep all of the criminals off of the street and away from minors.
Civil law seeks to resolve non-criminal disputes such as disagreements over the meaning of contracts, property ownership, divorce, child custody, and damages for personal and property damage. A civil court is a place where people can solve their problems with people peacefully. The function of civil law is to provide a legal remedy to solve problems. Sometimes civil law is based on a state or federal statute; at other times civil law is based on a ruling by the court.

  20. Criminal law protects people against being charged for a crime that they didnt commit, such as murder, arson, theft, and rape. It also allows a Judge or Jury review the case and make a decision based on the evidence that supports it.
Civil law allows citizens to sue one other and protects against wrong-doings. It allows us to sue for damages (money) to reinburse us for what another person took. It protects us against things such as damage of property, animal attacks, and broken or falsely sold items.
The United States Justice System is fair, in which it allows the accused to have a trial before a judge and allows the judge or jury preponderance of evidence that is brought up for or against the defendant. It allows witnesses to be supoened and questioned in court. It makes sure that most people get what they deserve and yes it has its flaws but what system doesn't?

  22. Criminal law is good because it helps get the psycho killer or rapist off the streets and away from the other citizens. It doesn't work all the time but eventually the justice will be served n them as well.
Civil law is good because it allows people to sue others and get their award from people that did them wrong. An example would be the Judge Judy case we watched about the lady scamming the other ladies out of the phones.

  23. civile and criminal law are two very useful things, if we did not have theim in the US we would not be the country we are today.Civil law protects against things such as scams, and damange done to property. you dont nee to be shure beond a reasonable dout that the person is guilty as in a criminal case.
with out criminal law america would be a terabol place to live in. in criminal cases you need to be apsolutly shure that the person convicted of the crime did it.

  24. criminal and civil law protect us from people who wish to do harm to us in one way or another. In civil law you can take your case to court and have a judge or jury dicide your case. By doing this you are hoping that the wrong done to you will be reversed and the wrongdoer will be punished. In criminal law people are proved guilty or not guilty by attonerys and are sentenced by a judge or jury. This to to give people a chance to prove they didnt do it and it gives the goverment a chance to take another criminal off the streets so were that much safer. The crminal justice system is vary fair, one main reason is for you to be guilty the evidence has to prove beyond a resonable doubt for you to be guilty and all members of the jory have to agree, if they cant the case is dismissed. Even if you are convicted you can always appeal it to a higher court.

  26. criminal and civil law helps fellow citizens of the u.s to prevent criminals from doing more and more damage to neighborhoods an towns. It protects us by putting all the criminals in jail or prison which then there would be less criminals off the streets so it will be safer. For example if you're property or you yourself gets hurt then the person who did it will pay for what they did.

    B) An yes the criminal justice system is fair because of the fact that people get their money back from getting scammed like the women from ebay yesterday and it gives people a chance to get back what was taken from them.

  27. civil law helps give justice to the little problems the American people have that does not break a federal law. I think it is very important to have civil law because if there was no civil law then there would be a lot of unhappy American citizens and justice would not be served.

Federal law is also just as important because it protects the American people from murderors and people who commit big federal law. So if Americans did not have federal law that would be tragedy for the saftey of the American people.

I think it goes both ways because most the time the Justice system is fair and correct but sometimes they get it wrong and it is not fair to the people who are affected by that. I think though for the most part that the Justice System is good especially with the new technology that will help cases have more clear evidence so they can make the correct rulling

  31. I beleive that the justice system mainly works for the people with money. For those that require a court appointed attorney, do not receive, in most cases, the attention needed to truly have a fair trial.
